Merits Proceedings

We handle merits proceedings in the construction sector for many clients. These matters turn on sector-specific knowledge and specific expertise in specific contractual terms and fora: it matters in which type of arbitration a dispute is resolved. We hold significant experience on arbitral proceedings re. national and international standard terms (such as UAV-GC and FIDIC) at, notably, the ICC, ICDR (also as arbitrator), NAI and Dutch Arbitration Board for the Building Industry.

Emergency Proceedings & Interim Relief

Our team is particularly experienced in seeking, or defending against, emergency and interim relief - also in the construction sector. Cases include timely delivery of parts for construction of energy projects, sharing of information and cease and desist orders. We have built this experience through handling cases in the Dutch courts and in arbitration. The Dutch jurisdiction is rather unique in its regime for emergency and interim relief. We also act as arbitrator in these matters and have conducted extensive empirical research in this area.
